1. Acceptance of Terms
These Terms and Conditions govern your use of our website and services. By accessing our website, placing an order, or making a reservation, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services. These Terms comply with German consumer protection law (BGB) and e-commerce regulations.
2. Our Services
We provide the following services:
- Dine-in restaurant services at our Frankfurt and Zwickau locations
- Takeaway and pickup orders
- Food delivery services within designated delivery areas
- Table reservations via website and telephone
- Catering services for events (subject to availability and separate agreement)
3. Online Orders and Delivery
When placing an online order:
- Orders are processed during operating hours. We reserve the right to refuse orders outside delivery areas or during peak times.
- You will receive an order confirmation via email. The contract is formed when we accept your order.
- All prices are in Euros (€) and include German VAT (Mehrwertsteuer). Prices are subject to change without notice.
- Delivery fees and minimum order values may apply. Estimated delivery times are indicative and not guaranteed.
- Menu items are subject to availability. If an item is unavailable, we will contact you to offer an alternative or refund.
- Please check your order upon delivery. Claims for incorrect orders must be made immediately upon receipt.
4. Payment
Payment terms:
- We accept cash, credit/debit cards (Visa, Mastercard), and online payments via Stripe
- Online payments are processed securely via our payment provider Stripe. We do not store your full card details.
- For dine-in services, payment is due upon receipt of the invoice before leaving the restaurant
- If online payment fails, your order cannot be processed. We will notify you and you may retry payment.
- You are entitled to receive a receipt (Quittung) for all transactions
5. Right of Withdrawal (Widerrufsrecht)
German consumer protection law grants you a 14-day right of withdrawal for distance contracts. However, this right does NOT apply to:
- Perishable goods (food and beverages) - Art. 312g BGB § 2(1)(2)
- Services fully performed with your prior consent before the withdrawal period expires
Due to the nature of our business (perishable food products and time-sensitive services), the statutory right of withdrawal is excluded for our standard orders. For defective or incorrect orders, please see Section 7 (Complaints).
6. Table Reservations
Reservation policy:
- Reservations are subject to availability and must be made at least 2 hours in advance
- We will confirm your reservation via email or phone. Please arrive within 15 minutes of your reservation time.
- Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may result in future reservation restrictions.
- Changes to reservations are subject to availability and should be requested at least 4 hours in advance
- For groups larger than 8 people, please contact us directly. Special terms may apply.
7. Complaints and Defective Orders
If you receive an incorrect or defective order:
- Please notify us immediately upon receipt by phone or email
- We will offer a replacement, refund, or credit as appropriate
- Complaints must be made within 2 hours of delivery or collection
- We handle all complaints in good faith and aim to resolve issues promptly
8. Limitation of Liability
Our liability is governed by German law:
- We accept unlimited liability for damages caused by willful intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit)
- We accept unlimited liability for personal injury
- For slight negligence (leichte Fahrlässigkeit), liability is limited to foreseeable, typical damages and only for breach of essential contractual obligations
- We are not liable for indirect damages, lost profits, or consequential losses unless caused by willful intent or gross negligence
Food Allergies: While we take care to accommodate dietary requirements, we cannot guarantee complete absence of allergens. Please inform us of allergies when ordering.
9. Intellectual Property
All content on this website, including text, images, logos, menus, and graphics, is protected by German and international copyright law. Unauthorized use, reproduction, or distribution is prohibited and may result in legal action.
10. Privacy and Data Protection
Your personal data is processed in accordance with GDPR and our Privacy Policy. By using our services, you consent to data processing as described in our Privacy Policy. For details, please see our complete Privacy Policy.
11. Dispute Resolution
Online Dispute Resolution (ODR):
- The European Commission provides an Online Dispute Resolution platform available at: https://ec.europa.eu/consumers/odr
- Our email for dispute resolution purposes is listed in the contact section
- We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration board, but we are willing to do so for amicable resolution.
- These Terms are governed by German law. For consumers, the place of jurisdiction is your place of residence. For merchants, jurisdiction is Frankfurt am Main or Zwickau (depending on the branch).
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website with an updated revision date. Continued use of our services constitutes acceptance of the revised Terms. For significant changes affecting existing orders, we will provide notice via email.
